(AP) ? It seemed like a good idea at the time.

But a health insurance tax credit for small businesses, part of President Barack Obama's health care law that gets strong support in public opinion polls, has turned out to be a disappointment.

Time-consuming to apply for and lacking enough financial reward to make it attractive, the credit was claimed by only 170,300 businesses out of a pool of as many as 4 potentially eligible million companies in 2010.

That's put the Obama administration in the awkward position of asking Congress to help fix the problems by allowing more businesses to qualify and making it simpler to apply.

But Republicans who run the House say they want to repeal what they call "Obamacare," not change it.

"They completely missed the target on this thing," Rep. Sam Graves, R-Mo., said of the tax credit. "I don't think expanding it is going to make any difference whatsoever." Graves chairs the House Small Business Committee.

It doesn't help the administration's plea that the biggest small-business lobbying group is a lead plaintiff asking the Supreme Court to overturn the Affordable Care Act. The National Federation of Independent Business isn't likely to spend much time tinkering with the tax credit or promoting it to members.

Small businesses represent the crumbling edge of the nation's system of employer-based health care. Only about 30 percent of companies with fewer than 10 workers offer health coverage, and they often pay more for insurance than large businesses. The credit, which once had support in principle from lawmakers of both parties, was supposed to help businesses already providing coverage afford the premiums. And maybe it would even entice some to start.

"We agree it is not a panacea for all costs," said John Arensmeyer, founder of Small Business Majority, an advocacy group that supports the health care law and disagrees with the much larger independent business federation. The problem is all the negative publicity around the health care law has discouraged business owners from applying for the credit, he says.

"There has been more heat than light shone on this," Arensmeyer said. "There is no reason why small businesses shouldn't be taking advantage of this credit." About 770,000 workers were covered by the businesses claiming the credit in 2010.

However, a recent report by Congress' nonpartisan Government Accountability Office identified several issues with the credit itself.

To begin with, the GAO said, the tax credit is structured so its biggest benefits go to very small companies paying low wages. About 4 out of 5 such businesses don't offer coverage, and the tax credit is not sufficient to encourage them to start doing so.

"Small employers do not likely view the credit as a big enough incentive to begin offering health insurance," the report said.

The average credit claimed in 2010 was about $2,700, although some companies qualified for much more.

Many small firms did not qualify because they paid fairly decent wages. The GAO report quoted an unidentified tax preparer who explained that "people get excited that they're eligible and then they do the calculations and it's like the bottom just falls out of it and it's not really there." It's almost a bait and switch.

Complexity has been another obstacle. IRS Form 8941, which employers must complete to claim the credit, has 25 lines and seven worksheets, the GAO said. Some tax preparers told the agency it took clients from two to eight hours to pull together supporting information and tax professionals another three to five hours to calculate the credit.

Trying to help, the IRS identified "three simple steps" employers needed to follow, but the GAO found "the three steps become 15 calculations, 11 of which are based on seven worksheets, some of which request multiple columns of information."

Arensmeyer said claiming the credit will be simpler once it becomes standard in tax-preparation software.

As it stands now, the credit is only temporary, expiring in 2016. That's another reason Congress appears unlikely to adopt the administration's proposed fixes, which would cost an estimated $14 billion that has to be offset with cuts elsewhere.

If the health care law withstands Supreme Court scrutiny, more employers could start claiming the credit. Otherwise, it may just go down as a missed opportunity, for policymakers and small-business owners alike.

At $279, should they buy it? That question's a little more complicated.

In a fjord in Canada scientists have found a landscape similar to one of Jupiter's icy moons: Europa. It consists of a frozen and sulphurous environment, where sulphur associated with Arctic bacteria offer clues for the upcoming missions in the search for traces of life on Europa.

It is not easy to find a place on Earth where ice and sulphur come together, supposedly like on Europa, Jupiter's moon. Nonetheless, this place has been located at Borup Fjord Pass in the Canadian High Arctic. Here the sulphurous yellow emissions contrast with the whiteness of the environment, creating images similar to those captured at Jupiter's satellite.

US researchers have now verified that the sulphur involved in the life cycle of Arctic microorganisms has some characteristics that could help to detect biological remains on Europa. Large space agencies like NASA and the European Space Agency are already in the process of preparing missions.

"We have discovered that elemental sulphur (S) can contain morphological, mineralogical and organic 'biosignatures' linked to bacterial activity. If they are found on Europa, this would suggest the possible presence of microorganisms," as explained to SINC by Damhnait Gleeson, lead author of the study and currently member of the Centro de Astrobiologia (INTA-CSIC, Spain).

The 'biosignatures' are associated with needle and rhomboid sulphur shapes in which mineralised remains of microorganisms and extracellular material appears. Thanks to electron microscopy and X-ray diffraction techniques, the formation of a rare type of sulphur has also been observed in association with organic components: the rosickyite. What is more is that small quantities (parts per million) of protein, fatty acids and other biomolecules have appeared in the sulphurous material.

"There is much evidence of bacterial activity," highlights Gleeson, who wonder if in the Europa's icy crust, or the ocean or lakes supposedly beneath it, there could be a similar microbial community that uses sulphur as their source of energy.

The researcher conducted the study, which has now been published in the Astrobiology journal, as a member of NASA's Jet Propulsion Laboratory and the University of Colorado in the USA. She is currently working as a scientist in the Centro de Astrobiologia in Ro Tinto (Spain), a place similar to Mars.

Diabetes drug could be a promising therapy for traumatic brain injury

ScienceDaily (May 29, 2012) ? TAU research finds that existing diabetes medication may ease damage caused by brain-addling explosions.

Although the death toll is relatively low for people who suffer from traumatic brain injury (TBI), it can have severe, life-long consequences for brain function. TBI can impair a patient's mental abilities, impact memory and behavior, and lead to dramatic personality changes. And long-term medical treatment carries a high economic cost.

Now, in research commissioned by the United States Air Force, Prof. Chaim Pick of Tel Aviv University's Sackler Faculty of Medicine and Dr. Nigel Greig of the National Institute of Aging in the US have discovered that Exendin-4, an FDA-approved diabetes drug, significantly minimizes damage in TBI animal models when administered shortly after the initial incident. Originally designed to control sugar levels in the body, the drug has recently been found effective in protecting neurons in disorders such as Alzheimer's disease.

Prof. Pick's collaborators include his TAU colleagues Dr. Vardit Rubovitch, Lital Rachmany-Raber, and Prof. Shaul Schreiber, and Dr. David Tweedie of the National Institute of Aging in the US. Detailed in the journal Experimental Neurology, this breakthrough is the first step towards developing a cocktail of medications to prevent as much brain damage as possible following injury.

Diabetes medication to halt trauma

Prof. Pick has been researching TBI for many years, beginning with the effects of everyday injuries such as hitting the windshield in a car accident. As a result of his work for the Air Force, he has expanded his research to include trauma sustained when a person is exposed to an explosion, such as during a terrorist attack.

TBI causes long-term damage by changing the chemistry of the brain. During an explosion, increased pressure followed by an intense vacuum shakes the fluid inside the brain and damages the brain's structure. This damage cannot be reversed, but mapping the injury through behavioral and physical tests is crucial to understanding and quantifying the damage and forming a treatment plan through therapy or medication.

Prof. Pick and his colleagues designed a pre-clinical experiment that exposed mice to controlled explosions from 23 and 33 feet away, and then analyzed the resulting injuries. They also studied the effect of Exendin-4 as an additional parameter in minimizing brain damage.

The researchers divided their mice into four groups: a control group; a second group that was exposed to the blast without medication; a third group that received the medication but was not exposed to the blast; and a fourth group, exposed to the explosion but given the medication within an hour after the blast and continuing for seven days afterwards. The mice were placed under anesthesia before the explosion.

Behavioral and physical tests showed that the mice that had been exposed to the blast had severely impaired brain function compared to the control group. However, the mice that had also received the Exendin-4 treatment were almost on a par with the control group in terms of brain function, proving that Exendin-4 significantly reduced the long-term damage done by an explosion. In separate experiments, the drug was also associated with an improved outcome in mice who sustained TBI by blunt force.

Finding the ideal drug cocktail

Prof. Pick says this promising discovery can help researchers find the ideal combination of medications to minimize the lasting impact of TBI. "We are moving in the right direction. Now we need to find the right dosage and delivery system, then build a cocktail of drugs that will increase the therapeutic value of this concept," he explains. He adds that in treating such traumatic injuries, one drug is unlikely to be sufficient.

This work was also done in collaboration with Dr. Bruce Citron from the American Veterans Association and Dr. Barry Hoffer from the National Institute of Drug Abuse at the National Institute of Health.

Although it is not a bad idea to take profits at anytime, sometimes we lose sight of the future. On the opposite side of the coin, holding a dying stock can also become a skeleton in the closet. I have seen more people ignore the day trading rules and cheer their way to a slow death more times than I would like to count. This is one of the most important day trading rules there is. Cut your losses! The first rule to day trading stocks is not to lose, a well timed entry will put you in an immediate green position. Study this rule, if you are sitting red you either hesitated and now you are holding a bag or you missed a crucial piece of the puzzle while you were in your research phase of your initial analysis. Remember these day trading rules and especially the one just mentioned.

Buying too early. Buying on dips can be a great strategy but we also don't want to end up catching a falling knife meaning a dropping stock, this is one of the day trading rules to always keep in our mind. A good example of this would be watching a stock price dramatically decline in value. A typical day trader may feel the price may be oversold, and then watch their trading account also collapse after making a entry too soon... Oops. Once the cash flow is gone from your account it is gone. So make your lessons count so they do not cost you dearly. In most situations it may be best to wait and use technical indicators to determine if a bottom has been confirmed before taking a entry. Also always remember in most situations you can get out of a stock with liquidity in an instant. Don't allow the stress of a red stock to take control of your trading. This is one of the day trading rules mentioned above. These day trading rules need to be your bible, read them daily, make them part of your trading personality. Do not get trapped by the hype or emotion of the trade, always remember other traders will seem the most excited about a stock when they are trying to sell. Until you understand the psychology and these trading rules this can be a very confusing time.

Day Trading Rules - Runners...

Runners are stocks that run up in price. They can last anywhere from a few short minutes to several days, weeks or even years. The problem with trading them, is that they are typically noticed by most people when the top is in. This is clearly a problem for those that decide to buy at the top. So what is the best strategy when trying to trade a Runner?

Get in early. When a Runner is first observed, the biggest mistake to make is waiting too long. Too many times we watch them go by, and say 'well I better jump in before it's too late.' By that time it usually is, your order is filled and the stock starts to reverse. If you had gotten in early, you could have been out near the top. It is always better to put in a stop loss and break even then to hold and end up red, day trading rules to live by. If you are trading without a day trading account this is ok! You will be allowed four round trip trades per week. If you get in and out of one and break even give it another try another day. Do not convince yourself that you have to always be in a stock! This is one of the major day trading rules and will be a samurai death in your trading career if you can't shake the buzz and walk away.

Selling during a price run can also prove challenging. We all want to see higher prices, but the reality is that good times never last forever and eventually sellers come in and take the price down. The key is to get out at the opportune time when the upward volume is still high. A trader can utilize various tools such as level 2 stock quotes which will give you an indication of the current supply and demand of the shares. When sellers begin to line up, clearly supply is outweighing demand and you can take your profits then. You can also use a combination of technical indicators or you can set a stop-loss. Whatever method you decide to use, determine it before you make your entry so you know when to take your exit. A professional day trader will always buy his shares on the bid and sell them on the ask with smaller more consistent profits. We have all seen big 100% gainers, but would you rather lose 50% on 5 trades in a row in search of one 100% runner? One of the most important day trading rules is that steady profits by the mansion.

Day Trading Rules - Stop-Losses...

A stop-loss will lock in your prices, so when selling begins, you are taken out of your trade with a profit. Make sure the spread in your stop limit is large enough so that your order does not get skipped. ?This day trading rule is important, if your stop limit order is skipped because only a market order is guaranteed you can find yourself in a panic position with no easy button. ?As one of the general day trading rules you should set a stop on all orders immediately after a buy order is filled. Stop-Losses minimize risk, and the stock market is all about managing risks. This will lock in profits and minimize losses. Depending on the exchange you are trading on, you may not be allowed to set a stop-loss or trailing-stop order but that does not mean that you shouldn't follow the day trading rules. For these instances you will need a 'Mental Stop' This is where you need to master your emotions once more and say to your-self. 'If the price falls to this level, I will exit my trade'. What we learned to do in these types of situations is to draw a line on the chart, once it hits that line you sell with no hesitation. ?Know one is watching you, it is just you and the market. ?Have no fear. ?This is one of the most important day trading rules. ?All too often we hold a losing trade and hope and pray that it will come back. We will be the first to tell you that we are all very religious, but the stock market is one of the few places God does not take part in. ?Praying won't help you here. ?This is rarely the case, and we are best of to follow our initial stop-loss day trading rules.

Day Trading Rules - Bounce Plays...

Bounce plays typically occur in 2 ways.

A stock that has usually just ran up very quickly in price a lot of speculation and buying comes into effect here. Eventually, selling begins to take over driving the price down creating a panic as traders scramble to get out of a falling stock. This occurs as a lot of people are in a panic, and are selling based on the fear emotion and a perfect time to be greedy, remember from the day trading rules above? Emotion... The stock will eventually reach a bottom and then bounce some nice gains. One of the most important day trading rules is to buy the fear and sell the greed. Sell into the volume and buy on the bid into the fearful selling once you are sure a bounce is coming into effect.

A stock has been trading sideways for a number of days or weeks. Next a negative news release or panic selling/short selling triggers a panic, the stock begins to sell and again, same rules apply as above. Emotions come into play, for fear of losing everything if they don't sell, and the stock at some point is oversold. I personally am not interested in holding a stock trading sideways, one of the best day trading rules is that quick consistent ins and outs ensure a green portfolio. Day Trading Rules - Learn From Your Mistakes...

Everyone wants to become a professional day trader and make profits to become successful. The day you stop learning from you mistakes is the day you will diminish your profits and ultimate goals. In all likely hood you will make mistakes, don't be afraid to accept this as a reality. This one of the important day trading rules. Do not be afraid to make mistakes, accept them, learn from them, and grow as a trader. Make sure your mistakes do not cost you dearly, minimize your risk while learning these valuable mistakes. One of the best day trading rules to be taught is to continue to grow without being taken out of the game and losing your trading account. These day trading rules are simply guidelines to assist you in minimizing the costs of your mistakes and to help you ultimately avoid the detrimental ones. How to Fit Facebook Into Your Design: Avoid the Suck of Social Media

I?ve done a number of presentations about social media and branding, and one question I usually get is how do you find time to keep up with social media. It can be a struggle to figure out how to have meaningful interactions on social media channels such as Facebook and Twitter without it sucking up all your time.

Making time and space for social media

As a designer, I also see another potential ?suck? of social media. The fact that small businesses need to throw a large number of social media icons and contact info into everything from their web site to their print ads or other marketing materials.

Yesterday, I was listening to the radio and heard an ad for a local garden shop. Out of the 30 seconds, a full one third of the time was getting out all their contact information. It started with their physical address and phone number, then went on to the URL of their web site, their Facebook page and finally their Twitter handle.

I see a similar crush in things like web site design.

Small business owners often feel that their web site design must incorporate a way for viewers to ?like? their company?s Facebook page. In addition, they may also display other friends who?ve liked their page. Viewers may also have the opportunity to ?like? pages within their web site. Finally, they may show a feed of recent Facebook activity. Beyond Facebook there are Twitter handles to share and Twitter feeds. And don?t forget LinkedIn, YouTube or Pinterest!

It can be a real challenge for the web designer to get all of these elements into the design and not look cluttered.

When is it too much Facebook?

I had been thinking about this topic and writing this post for a while, when I saw this headline on the Mashable web site. I took a screen shot because it really illustrates my point.

Social media I love thee, let me count the ways

  • Viewers can click ?like? in the lower left corner. I?m guessing this is to ?like? this particular article, which will have it show up as a status item in your own timeline on Facebook. You can see three more similar like buttons on each different article up there (ie Confirmed: SpaceX Dragon? and the others in the horizontal bar).
  • On the lower right it shows that more than 800,000 people have liked Mashable on Facebook. This means they?ve clicked on Mashable?s Facebook page and hit like there. If you do that, you?ll see Mashable?s posts show up in your own timeline (how frequently depends on many factors).
  • In the top right, you have the option of ?signing in with Facebook?. If you are doing something on the site that requires logging in?posting a comment for example?you can use this feature to make the sign-in process quicker.
  • Finally, near the middle top they are enticing readers to try their new ?Social News App?. I haven?t tried this, but they put the Facebook logo there one more time for good measure.
  • Beyond Facebook they also suggest you connect with them, or promote them via: Twitter, Linkedin, Google+, Pinterest and StumbleUpon.

Then, the irony of this screen shot is that the headline of the story suggests that nearly half of Americans think Facebook is a passing fad.

What about for your small business web site?

It?s important to realize that Mashable calls itself ?The Social Media Guide?. It is highly engulfed in the prominent social media channels and they are central to Mashable?s mission.

A small business web site, on the other hand, probably wants to tone this down. As I described above, there are now many different ways to post, like and interact with Facebook and it?s probably best to start by limiting it to what your web site viewers are comfortable with.

I?m going to wager that many, many people think that by hitting any ?like? button on a corporate site they?ve essentially ?liked? that company?s Facebook page, even when that is not always true. They may be just liking one page of web site content and posting it to their own timeline.

At this point, I think it?s best to start with this traditional way of sending viewers to Facebook to ?like? your company page. This, ideally, puts your ongoing Facebook posts into their timeline.

But this is a quickly evolving space. It seems like just as the masses get used to something in Facebook it all changes. And you may be forced to adjust your web site links. Also, think about the channels that mean the most to your audience. If they more heavily into LinkedIn or YouTube, than position those links most prominently.

TV Networks File Legal Claims Saying Skipping Commercials Is Copyright Infringement

Okay, we had?expected?the TV networks to possibly take legal action against DISH Networks for its new Auto Hopper technology, which allows DISH subscribers who use the Hopper feature (which records all prime time shows from the four major networks) to autoskip commercials, if they watch shows in the days after they originally air. It wasn?t a surprise that the TV networks didn?t like?this at all, but could they really make a?legal?argument that skipping commercials was against the law? We?ve all heard the story of former Turner Broadcasting exec Jamie Kellner claiming?that not watching commercials was ?theft,? but do the networks actually think there?s a legal basis for such claims?

It appears they do. Though, the legal arguments are?insane.

As you may have heard by now, Fox, CBS and NBC Universal?have all sued DISH in California. At about the same time, DISH itself filed for declaratory judgment in New York against those three, and ABC, who hasn?t yet filed suit, but perhaps will shortly. I would imagine that all of the cases will be consolidated in one of the courts.

What?s scary, however, is that the TV networks appear to be using this lawsuit to claim that skipping commercials is copyright infringement.?I haven?t yet seen the NBC filing, but the Fox and CBS filings both make this same basic argument.?Update: NBC filing is added below, and is nearly identical to the CBS filing, down to the very same lawyers. Fox first argues that merely recording the entire prime time lineup is making ?bootleg? copies of the videos. That?s a rather stunning claim, and a?direct?challenge to the Supreme Court?s ruling in the?Betamax case, which made it clear that time-shifting is legal. The networks are claiming that this is not the same thing, because the ?copies? aren?t being made by the user, but by DISH itself for use by the user. Beyond being a meaningless distinction, it?s also not true. As the Cablevision case concerning a ?remote DVR? offered by the service provider showed, if the actions are at the request of the consumer, then it?s?the consumer?making the call. With the DISH offering, the subscriber is still the one pushing the button and asking the DVR to record the shows. Is it really that different that it takes one button rather than punching in a few shows? That would be extraordinary ? but these filings are full of such extraordinary claims.

Where the filings go really off the wall is in basically saying that skipping commercials is infringement. They do this in the sections on ?inducement,? wherein they suggest that, even if DISH doesn?t directly infringe, it is is inducing infringement by offering the auto commercial skip feature to users. From the CBS filing:

Users of the Hopper?s PrimeTime AnyTime feature who record Plaintiff?s prime-time shows and use the Hopper?s Auto Hop feature to automatically skip commercials otherwise contained in those recordings infringe Plaintiffs? exclusive reproduction rights under section 106 of the Copyright Act,

But this makes no sense. Recording the show for later viewing is?already deemed legal. So the only difference here is?the intent?of the user to watch later to skip commercials. Thus, CBS seems to be saying that merely wanting to avoid commercials?is, itself, direct copyright infringement. And, given that Auto Hop doesn?t work until the day after the shows air, does that mean that it?s legal to record the shows if you intend to watch them the same day? but the second your?intention?is to watch them later, it?s copyright infringement? That makes no sense and has absolutely no basis in the law. And, uh, what happens if you record it with the intent to watch the next day and skip commercials? but then watch it the same day with the commercials? The allegation above says merely recording the shows with intent to skip commercials is infringement, even if you don?t actually skip the commercials! That makes no sense.

Fox?s filing makes similar claims, insisting that DISH is inducing infringement because it ?took active steps to encourage its subscribers to use Primetime Anytime to infringe FOX?s copyrights.? But that?s flat out malarkey. It?s?legal?for users to time shift shows. That?s established. Yet, these filings seem to want to?totally ignore that, and then assume that a user watching a DVR?d s how is automatically infringing on copyright because they might skip commercials.

The argument makes absolutely no sense at all. Effectively, the networks are trying to claim inducement to infringe? but do not (and, indeed, can not) show what or who is actually infringing. Time shifting is legal. Not watching commercials is legal. So, er, where?s the copyright infringement, unless you completely throw out the Betamax ruling?

The filings also go down the path of explaining how this disrupts their business model. They honestly seem to be arguing for what some people have amusingly referred to as??felony interference with a business model.??They list out all the different ways they get companies and users to pay multiple times for the same content, and use that to suggest this must be illegal, even though DISH has a retransmission license and all the individual parts are legal. I honestly don?t understand this argument ? they?re just claiming that because they don?t like how end users engage with otherwise legal content, it must be illegal. Fox even uses this to claim that DISH?s offering is?not??enhancing consumer choice.? Apparently, in the minds of TV network lawyers, what counts as ?consumer choice? is limited to what the TV networks want to count as consumer choice? and any other choices are no choices at all. Or something.

There are a few slight differences in the lawsuits. For example, Fox brings up the fact that DISH also offers the Slingbox to allow users to not just time-shift but also place shift, though fails to explain why that?s an issue at all. Fox also includes a breach of contract claim, which also may be difficult to support if all of the other actions prove to be legal.

DISH?s declaratory filing gives you a pretty clear sense of that company?s argument, pointing out that this is a nice feature that consumers want, that this kind of technology is already widely in use, and that it?s not clear how any of this is infringement.

Auto Hop is a more efficient way of achieving what consumers already do with standard DVRs. A 30-second skip feature is already standard on many DVR remote controls. It permits viewers to automatically skip ahead in a recording, at the touch of a button, completely bypassing a typical 30-second television commercial. The remote controls that come with DVRs supplied by Comcast, an NBC affiliate, can be programmed to include this 30-second skip feature. DISH has provided a 30-second skip feature for years. By pressing the 30-second skip button multiple times, a viewer can elect to bypass the full complement of commercials between show segments. Now, DISH allows the customer to opt to use an Auto Hop feature that is just an extension of this 30-second skip function. It avoids the common frustration that occurs when viewers, using the 30-second skip or plain fast-forwarding, overshoot the commercials and fastforward into the television programming content that they really want to watch.

DISH also points out that skipping commercials is not illegal:

DISH?s Auto Hop feature promotes consumer autonomy. Viewers have skipped commercials for decades. Viewers commonly use the commercial break as a time to get up and momentarily leave the room. Ever since the advent of the remote control, viewers have changed channels or muted the sound during commercial breaks. And, since the advent of the VCR and DVR, viewers playing back a show have fast-forwarded through commercials. DISH is simply making it easier for viewers to refuse to be a captive audience and to exercise the well-accepted choice to skip a commercial.

I can?t see how the networks? argument can stand very much legal scrutiny at all ? but stranger things have happened when copyright cases hit the court. Still, the arguments here are so bizarre, and so unsupportable, you have to believe a judge will reject them quickly.
