The body of a missing 12-year-old girl was found in a recycling bin not far from her home on Monday. Two brothers have been charged, though the motive is still unclear.?

The boys, ages 15 and 17, were charged with murdering Autumn Pasquale, who disappeared while riding her BMX bike Saturday, a little more than a week before what would have been her 13th birthday. She appeared to have been strangled, Gloucester County prosecutor Sean Dalton said at a late-day?news?conference.

The boys' mother had come forward with information about a posting on a son's Facebook account, Dalton said. He wouldn't say what was on the website or discuss a possible motive for the killing, but said there was no sign of sexual assault.

Autumn was lured to the house, where they apparently lived with their mother and stepfather, for the purpose of getting parts for her treasured BMX bike, which she rode frequently and talked about on her Facebook pages.

Both brothers were charged with counts including first-degree murder, body disposal and tampering with evidence. The 15-year-old was also charged with luring.

The boys' names were not released because they are juveniles, but Dalton said his office is considering trying to have the case transferred to adult court. The boys turned themselves in with their attorneys, public defenders, but it could not be immediately determined who they are.

The?girl's?body was found around 10 p.m. Monday in a recycling bin on a vacant property next to the home where the boys live, police said. The suspects had attended a community vigil for her shortly before the discovery, several residents said.

Autumn's BMX bike and other belongings were recovered from the boys' home, the prosecutor said. He did not detail all the items, but a backpack matching a description of the?girl's?was also seen being taken out.

One of the three teenage brothers who friends said live at the house traded BMX bike parts, according to a according to a young man, Corey Hewes, 19, who said he was among those who traded with him.

Neighbors also said the house was a place where teens frequently hung out and had parties.

The home is just blocks from Autumn's house and from the town hall, where thousands of people gathered for the tearful candlelight vigil to pray for her safe return in this town of 8,000 about 25 miles (40 kilometers) south of Philadelphia.

It's a boy! Greenville Zoo introduces baby giraffe Kiko - WBTV 3 ...

GREENVILLE, SC (FOX Carolina) -

Break out the blue ribbons and balloons, because the newborn giraffe at the Greenville Zoo is a boy named Kiko, officials announced Wednesday.

Autumn, the zoo's 6-year-old Masai giraffe, went into labor just before 11 p.m. Monday, according to Greenville Zoo Director Jeff Bullock. About 50 minutes later, Kiko arrived. He said the calf was walking by 12:45 a.m. Tuesday, and nursed for the first time just before 2 a.m.

Bullock stood in front of the zoo's giraffe exhibit and revealed details surrounding the birth of the calf during a press conference, including the angst felt by not only zoo keepers, but also from people around the world. Webcams installed at the zoo allowed nearly a million people across the United States, Canada, the United Kingdom, Sweden, Germany, Japan, New Zealand, Finland and France to witness the birth.

"From Facebook posts, we were able to see people worry before it took its first breath, before it took its first step, wondering if it was going to nurse," Bullock said. "These are things that the zoo keepers deal with on a regular basis."

Veterinarians examined Kiko on Wednesday, and said the newborn is about 5'8" tall and weighs about 118 pounds. They said Kiko may grow to be as tall as 16' and weigh about 2,600 pounds.

"From everything we can determine, he is a happy, healthy baby giraffe," Bullock said. "Autumn's instincts as a mother were perfect. Although she was surprised in the beginning, being her first calf, she quickly let instincts take over, cleaned up the calf, helped it to stand, helped it to nurse and has been an attentive mother ever since."

Bullock said they will keep Autumn and Kiko separate from the father giraffe, 7-year-old Walter, for about four weeks to allow the baby to nurse uninterrupted. He said that during this time, mother and son will switch off exhibit time with the father. He said ticket booth workers will keep visitors informed about which giraffe is on exhibit during their visit.

Kiko, which means Autumn's child in Swahili, was picked from a list of names that were submitted during a contest on WMYI-FM. The radio station will now work to coordinate a baby shower for the new family.

An unofficial poll on foxcarolina.com revealed that 53 percent of users were hoping Autumn would have a girl, while 47 percent were hoping for a boy.

Bullock said one of the best results of the whole experience was education.

"It was amazing the number of people that started looking up information, learning everything they could about giraffes," Bullock said. "So, it's been a great opportunity to not only introduce people to the Greenville Zoo and our giraffes, but [also] to get them thinking about animals and conservation."

Autumn is on a breeding loan from Boston's Franklin Park Zoo. She was paired with Walter, which is from the San Diego Zoo. According to an agreement, Franklin Park Zoo now owns Kiko. He will likely be moved to his new home after about a year. Autumn and Walter's second calf will go to the San Diego Zoo and the pair's third calf will remain at the Greenville Zoo. Bullock said he would expect to see another calf from the pair in about two years.

"Walter and Autumn, even though their status is on-loan, folks can expect to see them permanently here at the Greenville Zoo," Bullock said.

Giraffes are the tallest land animal in the world, and have one of the longest gestation periods of any mammal - 15 months. They also give birth standing up.

Uncle Arrested for Child Abuse, Murder of Toddler - Other Family ...

On Friday, Manuel Antonio Gonzales told authorities that his 21-month-old nephew had drowned while playing with a garden hose. However, when doctors examined Xavier Becerra Martinez, they found injuries consistent with child abuse on the boy?s body, CBS 5 reports.

Martinez later died at the hospital. Now Gonzales is facing child abuse and first-degree murder charges in his nephew?s death.

Xavier and two other children were in Gonzales? care on Friday when the incident occurred. According to authorities, Gonzales rushed over to a neighbor?s house, carrying Xavier and asking for help. Gaby Ramos, the neighbor, called 911.

?He was crying,? Ramos told CBS 5. ?He was like he didn?t know what to do and he had the baby in his hands and like he fell down. He didn?t fall down, but he went down on his knees and he was telling the firefighters to help him.?

When authorities arrived, Gonzales told them that Xavier had been playing outside with a hose and had drowned in a puddle. However, the boy?s injuries told a different story. The doctors told police that the injuries were consistent with child abuse, according to authorities.

Police searched Gonzales home and found wet clothing covered in mud and vomit on the washing machine, and a bloody towel in Gonzales? bedroom. When asked about the items, Gonzales told authorities he had no idea where the items came from.

Gonzales was arrested and charged with first-degree murder and child abuse. Any parent, guardian, or caretaker who injures or neglects a child to the point that the child?s health is endangered is guilty of child abuse in Arizona. If the abuse is intentional, as opposed to reckless or negligent, it?s a class 2 felony.

Beating a child, as is alleged in Gonzales? case, is considered intentional abuse. If convicted on the child abuse charge alone, Gonzales could spend anywhere from 10 to 24 years in prison.

As part of the settlement, Dish will pay $700 million in cash to Cablevision and AMC Networks. About $80 million of the cash settlement will be used for the purchase of Cablevision's multichannel video and data distribution services licenses in 45 metropolitan areas in the U.S., according to the companies.

Dish, which is based in Englewood, Colo., and has 14 million subscribers, also agreed it would resume carrying AMC, IFC, Sundance Channel and We tv.

The lawsuit had centered on Dish's decision for cutting short a deal to carry AMC's Voom HD, dedicated to high-definition programming. In July, the AMC channels ended up in the crosshairs of the legal spat. Dish dropped AMC, citing that the channels cost too much. But AMC argued Dish was just trying to gain leverage in the lawsuit. AMC had said that 13 percent of its subscriber base was affected by the blackout.

As part of a multiyear agreement, the AMC channel will be carried on Dish Channel 131, starting Sunday. Other AMC Network programming will return to Dish Nov. 1. The Madison Square Garden's music-oriented Fuse channel will begin broadcast Nov. 1 as well.

"We are glad to partner again with Dish Network and are delighted to bring back our popular channels and programming to their customers," said Josh Sapan, president and CEO of AMC Networks in a statement.

Dave Shull, senior vice president of programming for Dish said in a statement that a multiyear deal delivers a "fair value for both parties and includes digital expansion opportunities for AMC Networks' programming."

The lawsuit was filed in the Supreme Court of the State of New York, County of New York.

He said the best way to address issues was through bridging gaps among individuals and states by common understanding and sharing of knowledge about law.
He said that restoration of peace and harmony through adherence to the rule of law was the increasingly acceptable mean for resolving conflicts and terrorism, be it at international or domestic level.
?In societies where the rule of law is weak the law loses it force which leads the masses to violence and transgression,? he added.
He said, ?The greatest contribution that the law makes is that it makes peace through pacific settlements possible. Law is an instrument of peace primarily because it creates the possibility of durable and amicable settlements. As a secondary role, the law is also helpful in dealing fairly with those who have already violated society?s peace.?
He said that in the last five years Pakistan?s lawyers stood up for the rule of law in all areas of life, adding that once people began to stand for the rule of law many conflicts which previously seemed impossible to resolve, started to die down and peace was once again in sight.
He said, ?History teaches us that the most successful way for long-term resolution of conflicts is through law i.e through constitutionalism. ?Nation which value the constitution and its strict application have been successful in overcoming challenges and resolving conflicts,? he added.
He said that scholars were unanimous in reaching the conclusion that successive violations of the constitution and deviations from the rule of law, led us astray and eroded the rule of law in Pakistan.
?The cumulative effect of constitutional deviations and a weak rule of law in the past resulted in the present day militant and terrorist tendencies in certain regions of our country. The state has to respond and counter these militant organizations while responses, however, have to be within the framework of the constitution,? he added.
He said if the constitutional and law had been strictly followed, there would have been no room for resorting to terrorism and all outstanding issues could have been resolved. ?A cursory look at world history reveals the fact that economic development and law are intrinsically linked,? he added.
He said that societies where discretionary powers swayed rule-based governance and where individuals were stronger than institutions, the result was choas and anarchy where everybody loses in the end. ?The present superior judiciary in the country is making efforts that the rule of law prevails and corruption is rooted out from the system and that a transparent and rule-based environment is created where investment flourishes,? he added.
He said the electronic and print media had played a great role in sensitizing the people of Pakistan about the importance of the rule of law and supremacy of the constitution.
He said he believed that in the presence of the media the movement of the rule of law and supremacy of the constitution would succeed despite some concerted efforts on part of status quo-oriented powers to disrupt the flow of history.
He said, ?In the last decade, my learned brothers in the Supreme Court and I have had the privilege to give our constitutional jurisprudence a new direction. Law promise is real and if one stands for it, he is richly rewarded and one of the rewards is peace in society, leading to economic growth, flourishing trade, attraction of local and foreign investment etc.?
The Chief Justice also quoted several Quranic verses and Hadiths to highlight his viewpoint.
Supreme Court Bar Association (SCBA) President Yaseen Azad said that supremacy of the constitution, the rule of law and strengthening of institutions were important for democracy.
?Yesterday, the Supreme Court made a historic decision that institutions which do not have any role under the constitution should not take part in politics,? he added.

Obama promotes positive signs in housing market

WASHINGTON (AP) ? Eager to take note of signs of recovery, President Obama is drawing attention to improvements in the housing industry while keeping up pressure on Republicans to back policies the White House says would help struggling homeowners refinance their debts.

"One of the heaviest drags on our recovery is getting lighter," Obama said Saturday in his weekly radio and Internet address. "Now we have to build on the progress we've made and keep moving forward."

Obama cited an increased pace in construction of single-family houses and apartments in September. The Commerce Department said this week that last month's construction pace was the fastest in more than four years. Home sales are also up compared with last year, though sales dipped in September from August's two-year high.

With the economy still the dominant issue of the presidential campaign, Obama has been counting on voters believing that conditions are improving. But even indicators that are favorable to Obama still don't signal a strong recovery.

Obama conceded that too many mortgage holders are still under water, owing more than their homes are worth, and blamed congressional Republicans for not passing legislation he proposed in February that would lower lending rates for millions of borrowers. Republicans have objected, citing among other things the estimated $5 billion to $10 billion cost of the proposal.

Obama urged listeners to contact their members of Congress to push for the plan's passage.

"Let's be honest ? Republicans in Congress won't act on this plan before the election," Obama said. "But maybe they'll come to their senses afterward if you give them a push."

In the Republican address, Rep. Jeff Flake of Arizona said Obama had inherited a fragile economy, "but he's done little to improve it."

Flake, who is running for the Senate from Arizona, accused the Obama administration of regulatory overreach, citing examples in his own state to bar mining on certain lands, impose expensive requirements on power plants and threatening to require hotels and resorts to install lifts in pools and spas.

He called on Senate Democrats to pass a budget. "As bad as our fiscal challenges are, it's not too late," he said. "The bell has rung and it is time for us to get to work."

Gadhafi's former spokesman arrested, Libya says

(AP) ? The Libyan government on Saturday announced the capture of Moammar Gadhafi's ex-spokesman outside a besieged town, as the oil-rich North African nation marked the anniversary of the ousted dictator's death.

The statement by the prime minister's office said Moussa Ibrahim, who became the international face of the regime in its final months, was captured as he was trying to flee Bani Walid. The town has been the site of fierce fighting between pro-government forces and fighters holed up in what was once a stronghold for Gadhafi supporters.

"He is now being transported to Tripoli so that the investigation by relevant authorities can begin," the statement from the prime minister's office said.

The statement did not say what charges Ibrahim would face, but Libyan officials in the past have suggested he might be accused of incitement and disseminating false information.

A Facebook page purporting to belong to Ibrahim denied the capture, saying it was an effort to divert attention away from the "atrocities" being committed by the Libyan forces besieging Bani Walid. The site and statement could not be independently confirmed, but hours after the announcement of his capture, Ibrahim had not been seen in public.

Violence has flared periodically over the last year in Bani Walid, the most significant town in Libya still resisting the country's new authorities since the end of the country's civil war last year.

The urbane, English-speaking Ibrahim was the most well-known former regime figure to remain unaccounted for after Gadhafi was captured and killed by rebels as his hometown of Sirte was falling on Oct. 20, 2011, following an eight-month civil war.

Gadhafi's son and heir-apparent Seif al-Islam was captured by former rebels late last year. The regime's former intelligence chief Abdullah al-Senoussi fled the country but was later captured in Mauritania and extradited to Libya. The two men had been charged by the Hague-based International Criminal Court along with Gadhafi of attacking civilian protesters in the early days of the popular uprising. The case against Gadhafi was dropped after he was killed.

Other family members also fled to other countries, but their whereabouts are largely known.

The government statement added that Ibrahim was captured at one of the checkpoints outside Bani Walid, where fighting has raged for the past four days as government forces seek to retake the town.

Fighters of the pro-government Libya Shield militia have besieged the town, some 140 kilometers (90 miles) southeast of Tripoli, for the past several weeks, blaming residents for the death of a well-known anti-Gadhafi rebel.

An official at Misrata Hospital, who spoke on condition of anonymity because he was not authorized to speak to the media, said seven Libya Shield fighters were killed in Saturday's fighting and 120 injured.

Parts of Bani Walid, a collection of settlements in a well-guarded valley, are under government control, according to Mohammed al-Zubedi, a local official allied to Tripoli.

Residents in Bani Walid say the pro-government forces, which are comprised largely of the militias that overthrew Gadhafi a year, are indiscriminately shelling the town.

Frog Pond water likened to cloudy ale ? Local News ...

NEWBURYPORT ? City officials and high school science students combined forces last night in a continuing effort to plan for the revitalization of the increasingly unclean Frog Pond at the Bartlet Mall.

Students from Newburyport High School presented a preliminary report on water quality there to members of the Bartlet Mall Commission, which is developing an action plan for improvement.

And their science teacher, George Masterson, emphasized the students? points about poor water quality by comparing beakers from the Frog Pond and from the Artichoke Reservoir: The difference in color was like comparing a cloudy ale to a dry martini.

?The results you are providing is very valuable,? said Walt Thompson, chair of the Mall commission. ?As we move forward to seek funding and make changes, this data will be important.?

Students, who included Chris Cole, Alex Salah and Alex Silva, said that their studies found that there is a ?persistent proliferation of blue-green algae? that indicates high nutrient levels in the water.

The presence of E. coli has been detected. And the pond is constricting, though this could be a seasonal development.

The pond is normally 2.2 acres; it currently covers 1.8 acres, they said.

Masterson said that a key reason for poor water quality is the presence of fecal matter from pets and birds.

?The pond is part of a concave bowl,? he said. ?When it rains, the run-off includes what comes down from the roof (of the nearby courthouse) and from the walkways.

?There is a lot of litter that ends up affecting the pond.?

Because of such adverse circumstances, there are no frogs and few fish, if any, in the Frog Pond.

Masterson said he has discovered one snapping turtle. ?That must be a very tough turtle,? he said.

Thompson said the mall and the Frog Pond ?represent a jewel in the crown of Newburyport? and that his commission is determined to improve the area so it can be attractive to passers-by and livable for aquatic life.

?Improving the grounds around the pond might involve a culture change,? said Thompson. ?People might have to stop feeding the birds, or walking their pets? without cleaning up afterward.

Thompson said the commission will soon start raising money to provide equipment that could lead to improvements, such as aerators that can insert oxygen into the stagnant water.

Shoppers to splurge on themselves this holiday season

Holiday shoppers plan to deck the halls and splurge a bit more on themselves this year, but overall spending will remain cautious this holiday season as shoppers hunt out the bargains they know they?ll find this time of year, according to the results of a new survey.

The average holiday shopper will spend $749.51 on gifts, d?cor, greeting cards and more, up slightly from the $740.57 they actually spent last year, according to the survey conducted by BIGinsight for the National Retail Federation.

?We?ve seen this pattern of cautious optimism all year and despite the challenges that still exist in our economy, it looks as if consumers are eager to celebrate with friends and family,? said Matthew Shay, president and CEO of the National Retail Federation.

Recently, the NRF forecasted that holiday spending would rise 4.1 percent, slower than last year's growth, but higher than the average gains over the past 10 years.

?One for You, Two for Me?
This year, holiday shoppers are looking to treat themselves, according to the survey. Six in ten shoppers, the most in the survey?s history, plan to spend an average of $139.92 on ?self-gifting? this holiday season. The trend is even more pronounced among young adults between 18 years old and 24 years old, about 71.5 percent of those in this age group are planning to buy gifts for themselves.

?It looks like young adults have the ?one for you, two for me? mentality about the holiday season this year, which is surprising, given that this is also the age group that typically doesn?t have the income or ability to splurge,? said Pam Goodfellow, director of BIGinsights Consumer Insights division.

But it does make sense when you consider that retailers have conditioned shoppers to expect great deals on products during the holiday season. Consumers have been working hard over the past four years to hone skills to help them stretch their dollars and are likely taking advantage of the promotions, which have already started far ahead of Black Friday, the Friday after Thanksgiving that has traditionally been considered to be the start of the holiday shopping season.

Waiting to begin holiday shopping until after Thanksgiving is a tradition that clearly has been broken. About 41.4 percent of 8,899 consumers polled in early October told NRF that they will begin their holiday shopping before Halloween.

Despite the scorn, consumers embrace 'Christmas creep'

Although the NRF didn?t cite specific reasons why shoppers are starting their shopping early, retailers have been offering many incentives to get shoppers in the buying mood. Not only have stores such as Wal-Mart, Sears and Toys 'R Us?offered layaway programs, but there also were lots of promotions being offered as early as Labor Day weekend.

Stretching out the holiday shopping period also is a good strategy for more budget conscious shoppers who want cut any corners they can, comparison shop and spread out their purchases to soften the blow of holiday spending, and avoid the hangover of Christmas debt.

Retailers are pulling out the stops to get shoppers into the store early. Target began running its holiday ads this week, and it joined others such as?Best Buy and Toys ?R Us in offering price matching guarantees.

Trouble in Toyland: sales slowing heading into holidays

Economy less of a factor
Although these kinds of tactics may not move the needle significantly, it may make some more cautious customers feel more confident about making those purchases early.

This year, fewer shoppers in the NRF survey cited the economy as a factor in their spending plans, but the number remains high. Some 52.3 percent said the state of the U.S. economy would affect their spending, down from 62.2 percent last year.

That may reflect that consumers are simply accustomed to living on a budget and watching their spending, and may be better prepared for holiday spending.

According to the survey, the biggest portion of the holiday budget will go towards gifts for family members, with the average person planning to spend $421.82 on their kids, parents, and other family members. About $75.13 will be allocated to friends, $23.48 on co-workers, and $28.13 on others, including their pets and members of their community.

And don?t forget the decorations. Consumers are looking to be festive this year, and are pulling out the stops on d?cor. The average person will spend $51.99, up from $49.15 last year, and the most in the survey?s history. That means total spending on d?cor could reach $6.9 billion.

More shopping than ever will occur online, as has been the trend in recent years. More than half of all shoppers will do a portion of their shopping online, up from 46.7 percent last year.

And the most-wanted gift of all? Gift cards. Some 59.8 percent of those surveyed want to receive a gift card, more than other popular gifts such as clothing, books, DVDs, videogames and electronics. Nearly one quarter want jewelry, the highest response for this category since 2008.

After running with other alliterative codenames such as Oneiric Ocelot, Precise Pangolin and Quantal Quetzal, Canonical has announced the latest in its line of fauna-inspired Ubuntu releases -- Raring Ringtail. With version 13.04 CEO Mark Shuttleworth plans to start seriously laying the groundwork for phone, tablet and TV interfaces, which he hopes to have in place for the next LTS release in April of 2014 (14.04). Don't expect a full-fledged Ubuntu smartphone OS in six months, however, the first step will be working on core aspects of the OS, such as power and memory management, that will prove crucial to its success as a mobile platform. SURA has launched an institutional tool for Research Data Management (RDM), developed by a working group formed with the Association of Southeastern Research Libraries (ASERL). The working group brings together CIOs and library professionals from SURA member institutions to explore collaborations for improving their ability to manage the rapidly growing volume of research data.

The working group produced an institutional "Step-By-Step Guide to Data Management," which is being used to identify gaps in existing RDM processes and guide future efforts of the group. The group, comprised of over 50 individuals from more than 25 SURA member institutions, meets in bi-weekly conference calls to develop and prioritize RDM topics. The "Step-By-Step Guide to Data Management" was developed as the result of a survey of the SURA membership to identify goals and projects for improving the management of institutional research data.

The effort has been driven by new requirements from funding agencies and the research communities' needs to effectively manage the ever-increasing size of its data sets. The National Science Foundation (NSF), National Institutes of Health (NIH), and other research sponsors now require a comprehensive data management plan as part of all new funding proposals. Other factors:

  • Ensuring research integrity and replication and the accuracy and reliability of data and records;
  • Increasing research efficiency;
  • Enhancing data security and minimizing the risk of data loss;
  • Preventing duplication of effort by enabling others to use data; and
  • Complying with practices conducted in industry and commerce.

This Research Data Management Project is but one of SURA's many scientific and educational collaborations among its member institutions, other leading research universities, and government agencies.

SURA has launched an institutional tool for Research Data Management (RDM), developed by a working group formed with the Association of Southeastern Research Libraries (ASERL). European Data Regulators Slam Google Over Privacy Policy: ?Too Large? And Users Need More Control (But Not Illegal)

Google logo 215Authorities in Europe today kicked off a fresh wave of scrutiny over Google's privacy policy and called for changes to be made in how Google manages user data, describing Google's scope as "too large". But they also stopped short of saying Google is acting illegally in how it manages privacy or demanding a change in its wider policy. France's data protection authority, the Commission Nationale de l'Informatique (CNIL), today published a list of recommendations for the company in the area of user privacy, following an investigation that began earlier this year.
